- 1). Maintain significant ties with Canada in accordance with Canada Revenue Agency requirements. Keep an owned or leased home, leave a spouse or common-law partner in Canada or leave dependents in Canada. Maintain your Canadian residence as your own residence. Do not lease or rent it to another party.
- 2). Maintain secondary residential ties with Canada. Courts will consider secondary ties collectively and in conjunction with significant ties, in determining residency. Leave personal belongings such as furniture, clothing or vehicles registered in Canada. Continue employment with a Canadian employer or actively participate in ownership of a Canadian business. Keep Canadian bank accounts, retirement funds, securities accounts or credit cards. Retain a Canadian driver's license. Keep a valid Canadian passport.
- 3). Continue provincial health care coverage. Stay in the province you are maintaining ties with for at least 183 days of each calendar year to be eligible for health care coverage.
- 1). File an income tax return with Canada Revenue Agency for every year you are a resident of Canada.
- 2). Download Canada Revenue Agency Form NR73, Determination of Residency Status (Leaving Canada) from the agency's website (cra.gc.ca). Mail the completed form to the address given on the form.
- 3). Keep a travel log if you travel frequently between Canada and the United States for work, business or pleasure. Ask the Canadian border security officer to stamp your passport each time you enter Canada.
