- 1). Report the crime to your appropriate banking institution and the Federal Bureau of Investigation. Explain the situation to the banking representative. Go through your financial record history -- as far back in time as necessary -- with administrators to clarify how long skimming has taken place. Document all conversations and collect the names and titles of all administrators with whom you speak. Contact one of the 56 FBI field offices -- depending on the state in which you live -- to report the crime to federal authorities. Log online and visit the FBI Map of Field Offices page to find contact information for the division in your area.
- 2). Go to the office of the clerk for the U.S. District Court in your area. Visit the office of the clerk for your state Supreme Court, if necessary, for additional assistance and support.
- 3). Present the clerk with a minimum of two forms of identification -- a passport and birth certificate, for example. Tell the clerk you are the victim of a skimming scam and request a Petition Claiming Fraud.
- 4). Fill out the Petition Claiming Fraud. Describe the details of your accounts, the discovery of the misdeed and your actions to report the crime to appropriate authorities. Make three copies of the petition and any supporting documentation -- financial records, for example -- that validate your case.
- 5). Return two sets of copies -- of both the petition and supporting documentation -- to the clerk. One set is kept for court records and the other set will be included in the summons for the defense. Keep the third set for your records. Steps one through five are essential for ensuring subpoenas are obtainable. Speak with the clerk about hearing and trial dates subsequent to the filing of your petition.
- 6). Ask the clerk and/or your lawyer to follow up with subpoenas. Subpoenas are court orders for individuals to appear at hearings and/or trials to provide witness testimony. Identify who must be subpoenaed with regard to your case -- bank officials or business accountants, for example -- and complete a Petition to Subpoena Witness as directed by the court administration.
