- 1). Obtain a Petition to Answer or to Reopen Small Claims Judgment and Order form. These are available from the clerk's office of your local circuit court, or you can download and print one from the link provided at the bottom of this page. This must be done within six months of the settlement.
- 2). Fill out the form completely and have it notarized by a registered notary.
- 3). Turn the petition in by hand to the circuit court. Some circuit courts will allow you to mail this, others may not. Some courts may also charge a fee once your case has been reopened.
- 4). You will be informed if your settlement is being reopened, with a new date set for you to appear before the judge.
