How to Apply for Removal of Conditional Status without a lawyer

    • 1). You have to apply in the 90 days period before your second aniversary as a US resident.If you fail to apply in this period you can lose residency and can be deported.For example, if you become resident on 03/15/2006 you have to apply for adjustment of status between 01/15/2008 and 03/15/2008.

    • 2). Start preparing your documents and evidence as early as six months before you actually apply for removal of conditional status.You may need an affidavit or another document that needs time to be obtained.

    • 3). You will need any kind of documents that prove that you have a genuine marriage:joint accounts,joint lease on the house, pictures together and with family and friends, plane tickets from your trips together,copies from any document that show that you live at the same adress, copies of birth certificates of your children (if you have any).Include a copy of the first green card, a copy of the marriage certificate and copies of your birth certificates (yours and your spouse's).The basic rule is to try to send as much documents as possible, to a void an RFE (request for evidence) that will slower your case.

    • 4). Download the most recent version of I-751 form (Petition to remove Conditions on Residence) from USCIS site and complete it carefully.Write a cover letter that expains what you are sending in the package.You can find samples and models of cover letter online. ( just type "removal of conditions cover letter" in google).

    • 5). Try to add at least one affidavit for some good friend/family/parent who knows you and your spouse.The affidavit should state for how long they know you ,that you live together and the last time you were seen together.Some say that the affidavits are the weakest piece of evidence, but it's better to include one.

    • 6). Check for the fees on I-751 on USCIS website.They change the fees quite often, so write the check with the fees in the day that you are sending the application, just to be sure that it's the most recent fee.
      Put all the documents together and organize them in a file, and then send them with USPS Priority Mail, with Certified Mail.In this way you will have a proof that you sent your application.Good luck!
