How to File an Appeal Against a Judgment

    • 1). Decide if you want to be represented by a lawyer. Understand that states' laws vary, so check and see if you can be represented by a lawyer in your state. Even if you can be represented by a lawyer, consider the costs. Considering the dollar amount, it may not be worth it to you financially to hire a lawyer,

    • 2). File a notice of appeal. Note information which includes time limit to file, the appropriate appellate court to file, filing fee, and bond requirement.

    • 3). Read the trial record. Decide what portions you would like to submit for review. For instance, if you felt that a witness called was prejudiced against you because of statements made, you can have this section entered into review.

    • 4). Remember - that the court can only reverse the original decision if an error of law occurred in the trial record. For this reason, the trial record must support your reason for appealing. In other words, the proof is in the trial record. No proof = no case.
