- 1). Go to the county court and ask for any paperwork needed to file a set aside motion.
- 2). Fill out the forms and make at least two copies of everything.
- 3). Write a letter of intent to file a motion to set aside, outlining any relevant facts that could have lead to mistrial. Using a lawyer is the best bet. He can draft a properly formatted and more convincing argument. If a lawyer isn't an option, try to find a good sample document on the Internet.
- 4). Turn in all forms and the letter of intent by hand to the county court.
- 5). Wait for the court to send a letter indicating its decision to grant a retrial or hold to the initial indictment.
