Texas Law on a Widow's Homestead

    • Under Texas law, a widow may live in and use the residence she and her husband occupied while married. She is legally allowed to reside there until her death or until she chooses to move.

    Trusts

    • These rights apply even if the title to the home is part of a trust. The trustee is not allowed to divide the homestead or interfere with the widow's right to reside in the home. If the widow dies or leaves the home, ownership reverts to the trust beneficiaries.
