You're the not-so-proud owner of a new speeding ticket. You'd love to know how to get our of a speeding ticket, right? Here's a basic formula to handle your everyday, run-of the mill speeding ticket. (None of this applies to racing, accidents, or DUI.)
1. Stay Calm at The Incident Site
The first step to getting out of speeding tickets is to remain calm and polite to the officer when you are stopped. If a radar gun was used, of course they were out to get you! Get over it. Ranting when stopped is kind of an offense all by inself. Keep it all calm and cool and you may just get a verbal warning.
2. Admit Nothing
When the officer asks you if you know why you were stopped, try this: "No, I'm really not sure." If you say anything the even could be construed as an admission, just get your checkbook ready. By the way, sharing a standard sob story will not help.
3. Go to Court
At some point during the traffic stop, simply mention in passing that you believe it's important that all citizens have their days in court. Indicate you will be personally present in traffic court. (That normally means the officer will also have to plan to be in court, maybe on a day off. Maybe the officer will be a no-show.)
4. Show Up Looking Sharp and be Respectful
Please shave and wear your best clothing - ties for men and skirt and blouse for ladies is good. Everyone on the other side of this dispute in the courtroom is a officer of the court. Courtesy and respectful behavior is normal and expected.
4. Focus on The Charge
Normally, you're not just charged with speeding. You're charged with a specific speed like 41 mph in a 35 mph zone. The specificity is the weakness in the case. How did the officer determine that specific speed accurately?
5. Challange the Accuracy of the Recording Device
If the officer's speedometer was used, challenge (politely) the accuracy of the it. If a radar gun was, used, challenge that. When were these devices last calibrated? Ask for proof of the calibration testing (the original results - not a photocopy). If they can't be produced, ask that the charge be dismissed.
