- 1). Send a cease-and-desist notice through certified mail to the person who has infringed upon the copyright, requesting that the continued use of the copyrighted material stop immediately. Include an example of the illegal use of your work.
- 2). Seek a formal injunction from U.S. District Court. Even if the other party ceased to use your material once notified of the infringement, you may be due compensation for damages and lost revenues, as there was a period of time that royalties should have been paid on the use of the copyrighted material.
- 3). Negotiate with the other party to reach an out-of-court settlement for any damages and royalties that may be due you. Failing an amicable resolution, judicial remediation can be sought.
- 4). File suit with United States Superior Court alleging the copyright infringement.
