Georgia Workmen's Comp Laws

    Eligibility

    • All employers with more than three employees must provide workmen's compensation insurance in the state of Georgia. This includes part-time employees. As long as an employer has three or more workers, employees are covered from the first day on the job. Workmen's compensation only covers those injuries incurred while working.

    Medical Care

    Income Benefits

    • If an injured employee is not able to work for seven days or longer, then the employee is eligible to receive weekly income benefits. These weekly benefits will equate to 2/3 of that employee's average weekly wage, and the first check must be mailed to her within 21 days of her first day of missed work.

      Weekly income benefits may be received for up to 400 weeks, except in the case of extreme injuries. When an employee can no longer work in his chosen field due to an injury suffered on the job, then he may be eligible for lifetime disability benefits.
