- 1). Download or request via telephone or mail a copy of Form SC-100 (individual) or SC-99 (business), the San Bernardino forms for small claims filing cases. Fill the form out and name yourself as the plaintiff in the case. You are allowed to file a claim up to $7,500, or $5,000 if filing as a business. You may file no more than two cases over $2,500 within one calendar year, so make your claim count.
- 2). Fill out the process serving section with the defendant's address and contact information. For an additional fee, the county will serve papers on the defendant.
- 3). Consult Question 5 on the SC-100 or SC-99 form to determine the correct courthouse for your claim. Make sure to file in the correct venue, or the case will be dismissed. If you are unsure and have questions as to the venue, call 909-382-3650 or 800-634-9085 for assistance.
- 4). File your claim electronically, by mail or in person. Mail or hand deliver the completed forms and fees to: San Bernardino Civil Courthouse, 303 W. 3rd St., Basement , Self Help Services, San Bernardino, CA 92415. Get the date for the court appearance and prepare your papers and proof for the upcoming court date.
