- 1). Read the USPTO's website thoroughly. A good place to start is their FAQ at http://www.uspto.gov/web/trademarks/workflow/start.htm. If you are unsure about any aspect of the trademark application process, get advice from a trademark attorney licensed in your state.
- 2). Prepare a clear representation of the mark. You will need to provide this to the USPTO so that they can ensure it is not too similar to other registered trademarks. As a joint venture, you will need to ensure that the reference is owned by the joint venture rather than the individual who prepared it. You can do this by having everyone involved sign contracts stating that the joint venture owns the work.
- 3). File an application through the Trademark Electronic Application System, available at http://www.uspto.gov/teas/index.html. You will need to ensure that the joint venture owns the application. As in Step 2, have everyone sign contracts to that effect.
- 4). Monitor your email for any communication from the USPTO. They may require additional information from you or reject your application outright. You should promptly respond to any of their questions to minimize the chance of rejection.
- 5). If your application is rejected, re-apply with a different mark or appeal to the Trademark Trial and Appeal Board.
